内容記述 | In the 2010s, Islamic extremists established the “Islamic State” (the “State”) in Iraq and Syria. The “State” used social networking services and other means to attract people from Europe and North Africa, who became “citizens” of the “State”. The “State” lost power due to the international community’s unified response. Parents who had become citizens of the “State” were captured by Kurdish forces in northern Syria. These parents were detained in Kurdish-controlled camps along with their children, who had either been born in Syria or taken there by their parents from Europe. This article discusses and explains the case of a communication made by the grandparents of such children to the Committee on the Rights of the Child, in which they requested France to allow their grandchildren to return to their country. The Committee on the Rights of the Child decided that the Convention could be applied even extraterritorially as France had the capacity and authority to return these children to France. This decision is unique in that it differs from the requirements for the extraterritorial application of human rights treaties that have been accepted in the past. Nevertheless, there are also concerns that applying human rights treaties to matters over which the governing party has no practical control could result in a weakening of the treaties system. |
